You have arrived at our terms and conditions for use of this Site by you. These terms and conditions, together with the bobPay User Agreement, Billing Statement, the Rating Systems Rules, Listing Policy, Verified User Agreement, Privacy Statement, Affiliate Terms and Conditions, SMS Terms & Conditions, Mobile Device Terms & Conditions, Stores Terms & Conditions and bobBucks Terms & Conditions and Buyer Protection Programme Terms & Conditions (and the "Annexures") form this Agreement.
This Agreement is a binding agreement between you and Bob Shop. It also sets out some of the terms and conditions governing Bob Shop allocating Gift Vouchers to you or you buying or redeeming Gift Vouchers, so please read it carefully. If you are uncertain, or you do not agree with the terms and conditions or any of the Annexures then you should not accept them. Any complaint or claims with regard to the Gift Vouchers may be directed to hello@bobshop.co.za.
1.1 may allocate electronic Gift Vouchers to users and / or potential users from time to time; or
1.2 make Gift Vouchers available to be purchased on the Website from time to time by users or potential users, which Gift Vouchers are capable of being redeemed on the Website.
1.3 When Bob Shop allocates Gift Vouchers to users or potential users, or users purchase Gift Vouchers from the Website, a bobBucks account will automatically be created for the user once the user attempts to redeem the Gift Voucher in order to keep track of important conditions attached to the Gift Vouchers such as the balance available to redeem in the bobBucks account and the expiry date recorded on the Gift Voucher in addition to any other terms and conditions attached to the Gift Voucher, including those terms and conditions stipulated below, amongst others. The terms bobBucks, bobBucks account, bobBucks balance, bobBuck voucher, Gift Voucher, Gift Voucher Account, Gift Voucher Balance, Available Gift Voucher Balance or any derivative thereof may be used interchangeably on the Website or in any correspondence from Bob Shop.
1.4 Gift Vouchers may have specific restrictions on how the total or balance remaining can be applied to purchases on the Website. You are required to specifically familiarize yourself with these terms and conditions in addition to any other terms and conditions attached to any specific Gift Voucher allocated by Bob Shop to you, or purchased by you from Bob Shop.
2.1 You must have a valid Bob Shop account registered in South Africa to redeem a Bob Shop Gift Voucher.
2.2 The risk of loss to and title for Gift Vouchers only passes to the purchaser or user or potential user upon Bob Shop electronically transmitting the Gift Voucher to the purchaser or user or potential user or on delivery to the carrier, whichever is applicable.
2.3 Gift Vouchers can only be redeemed:
2.3.1 While they are valid. You are specifically required to read the expiry dates. The expiry dates will not be extended beyond the specific expiry date recorded on the Gift Voucher;
2.3.2 On the Website for the purchase of products sold by sellers on the Website and where the seller accepts bobPay as a payment option;
2.3.3 Invalid or expired Gift Vouchers will not be capable of being redeemed.
2.3.4 Gift Vouchers have their expiry dates listed under “My Bob Shop” in the Gift Voucher section on the Website.
2.3.5 Unverified Bob Shop accounts are limited to a maximum of R1,000.00 in Gift Voucher purchases in any 30 day period and verified Bob Shop accounts are limited to a maximum of R10,000.00 in Gift Voucher purchases in any 180-day period.
2.3.6 Bob Shop has the right to suspend or to close user accounts at Bob Shop's sole and absolute discretion and bill alternative forms of payment to the user if fraudulently obtained Gift Vouchers are redeemed on the Website or purchased by you.
2.3.7 The purchasers of and redeemers of Gift Vouchers must be 18 years of age or older. You warrant and agree that you are 18 years old or older, or you have received your parent or guardian’s permission if you purchase and / or redeem Gift Vouchers.
2.3.8 Bob Shop expressly reserves the right to change the terms and conditions of the Gift Vouchers Program at any time or to outsource or contract with a third party to administer this Program.
3.1 Gift Vouchers cannot be:
3.1.1 used to purchase other Gift Vouchers;
3.1.2 used towards purchases at any affiliate website/s including but not limited to: www.bobshop.co.za);
3.1.3 exchanged or traded for cash; or
3.1.4 transferred, or assigned or ceded to any other person once redeemed towards a purchase, partially or in full when already linked to your bobBucks account.
3.1.5 Gift vouchers purchased by means of credit card may not be used for payment of motorised vehicles and property.
3.1.6 Gift Vouchers may not be used to pay Bob Shop fees.
3.2 Certain Gift Vouchers may be product or category specific as recorded on the Website from time to time and can therefore only be used to purchase specific products or products listed in a specific category/ies on the Website.
3.3 The value of the Gift Voucher will be set off against the value of your shopping cart, including any shipping costs if applicable, and the balance remaining, if any, will be payable by you, failing which the transaction will not be capable of being completed or fulfilled.
4.1 Users do not have a right to Gift Vouchers and Gift Vouchers cannot be earned. Gift Vouchers are issued electronically only for the time being and at Bob Shop's sole and absolute discretion.
4.2 Gift Vouchers are issued under specific terms and conditions regulating when and how they may be used. As a general rule, and unless specified otherwise on the specific Gift Voucher itself:
4.2.1 this Gift Voucher can only be used with promotional offers on the Website;
4.2.2 Only one Gift Voucher can be used per user and per promotional campaign;
4.2.3 The value of the Gift Voucher will be set off against the value of your shopping cart, including any shipping costs if applicable, and the balance remaining, if any, will be payable by you, failing which the transaction will not be capable of being completed or fulfilled.
4.3 Gift Vouchers cannot be:
4.3.1 used to purchase Gift Vouchers;
4.3.2 used towards purchases at any affiliate website/s of Bob Shop, including but not limited to www.bobshop.co.ke;
4.3.3 exchanged or traded for cash;
4.3.4 transferred, assigned or ceded to any other person.
4.4 Bob Shop specifically draws to your attention that certain Gift Vouchers may be time, product or category specific, which means that the Gift Vouchers can only be used to purchase specific products or products listed in specific categories on the Website within a specific period of time.
5.1 Bob Shop and it’s directors, employees, partners and affiliates shall not be liable for any damage, loss or liability of any nature whatsoever incurred by you or any other person whether resulting from the purchase, redemption or use of the Gift Voucher.
5.2 You acknowledge and agree that the Gift Voucher Program may be inoperative from time to time which may affect your use and enjoyment of the Gift Voucher and Trade Coupon Program, due to general upgrades to our Website or for any other cause beyond our control. In this case you may be unable to obtain information about the balance on your bobBucks account or use your Gift Vouchers or Trade Coupons to pay for your purchases. Accordingly you agree that Bob Shop will not be held liable for any interruption of service.
6.1 You hereby agree to indemnify, hold harmless and defend us, our affiliates and agents against any and all claims, liabilities, damages, costs and expenses (including but not limited to consequential damages and any other damages, or costs or expenses of whatsoever nature) arising from or relating to:
6.1.1 The use of the Gift Vouchers Program which may violate or may contravene the terms of any law, rule or regulation;
6.1.2 Any claims made by third parties arising from the use of the Gift Vouchers Program, including but not limited to any failure, delay, unavailability or interruption caused when using the Gift Vouchers Program on the Website.
